Planning board recommends adoption of updated municipal stormwater-control ordinance to align with DEP rules

The Township of Washington Planning Board on Oct. 23 recommended the governing body adopt an updated stormwater-control ordinance that mirrors the short-form model required by the New Jersey Department of Environmental Protection (NJDEP).
Planner Mr. Lydon and board engineer Paul Hasnumba explained the ordinance implements the state’s recent amendments to stormwater-management and inland flood-protection rules (cited in testimony as the stormwater subchapter 7:8 regulation). Hasnumba said the township is adopting the short-form model ordinance prepared by the township’s consultant, Storm Water Compliant Solutions, and described thresholds that trigger the local rules: major development is typically defined by one acre or more of land disturbance and other triggers include certain increases in motor-vehicle surface coverage or impervious surface (quarter-acre thresholds).
Hasnumba advised the board that larger projects will be most affected and that the short-form model is consistent with state guidance. Board members asked how the ordinance would affect pending or approved applications; Hasnumba said projects with final, vested stormwater approvals (such as Franklin Court) would retain their approvals, while other cases (for example, Viviano) could depend on ongoing court actions. The draft ordinance was presented to the board with a letter from the town administrator confirming the draft’s consistency with the master plan.
After no public comment, the board voted to recommend approval and directed staff to forward the draft ordinance and supporting materials to the mayor and council for presentation at a council meeting.
