Canopy proposals for boat lifts prompt code review; committee agrees to hear condo group presentation

The matter is significant because current city code does not provide a clear pathway under the special‑permit sections for canopies attached to boat lifts, and council requested the committee's recommendation after a presentation. Committee members raised concerns about aesthetics, durability, storm damage and legal limits on construction beyond the seawall.
Mark Storm, city maintenance staff, introduced the topic and said the group should be allowed to present: "If there's consensus today for you guys to hear that on a future agenda, then we can go ahead and let that group know so that they can provide a presentation to you at the next..." After discussion, the committee agreed to change the public comment option (three minutes) to a full presentation and discussion (up to 30 minutes) at a future meeting.
Committee members flagged several concerns. Jake Dye said, "If you wanna know why it's not good to have boat covers, you know, in Punta Gorda, just take a ride through the...canals over there and look." Jean Fuller urged caution because "Punta Gorda is somewhat unique in that everything beyond the seawall belongs to the city, not to the owners," cautioning that city ownership of the area may affect legal outcomes. Brian Clements, Public Works staff, said "I don't think we have anything to lose by listening to the presentation and and get a little bit smarter on what this is about."
Staff and the committee discussed code pathways. Brian Clements noted the current special‑permit code does not list canopies as an allowed special exception, so a code amendment might be the route for a general allowance rather than case‑by‑case permits. Several members referenced experience in other jurisdictions where similar proposals led to lawsuits or visual‑quality concerns.
The committee did not vote on an ordinance change at the meeting. The next step is to place the condominium group's presentation on a future agenda; after hearing the presentation, the committee may vote to recommend that City Council pursue a code amendment or to advise denial.
