State Court revokes probation and orders jail or restitution in two cases

The State Court of Clayton County on May 20 resolved multiple probation matters, revoking part or all of probation in two cases and setting terms for release or payment.
The court revoked 60 days of probation for Henry Lee Carroll III after the petition described a May 7 arrest for criminal trespass, missed probation reporting, an uncompleted theft-prevention class and $50 in outstanding fees. Probation recommended a 60-day revocation, credit for time served since May 7, and closing the case; the court accepted that recommendation and ordered Carroll to serve 60 days at the Clayton County jail, after which the case will be dismissed, per the court's announcement.
In a separate matter, the court addressed Philip Yaron Whitaker’s outstanding obligations stemming from a 2022 disorderly-conduct sentence on probation. The court found numerous missed probation reports and arrearages totaling $872 as outlined on the record. Probation recommended revoking the remaining balance of probation, and the court ordered revocation with a release condition: Whitaker may be released upon payment of $472 in restitution to the Office of Probation Services or upon serving the full revoked time. The court directed counsel to coordinate with family and the probation office on payment logistics.
Judge Long Hayward told both defendants that regular reporting to probation and timely payments are necessary to avoid repeated returns to custody: "The quickest way to get rearrested is to fail to complete your probation reports," she said in admonitions during the calendar.
The court scheduled follow-up coordination between defense counsel, the DA's office and probation to resolve outstanding documentation and to determine whether any matters required transfer or further motions.
