Rules committee considers repeal of city ordinance requiring candidate report four days before election

Sponsor Councilman Fusco told the committee the local requirement is redundant because candidates and their treasurers already file a report 10 days before an election and reported filings are now available online within one to three business days after submission by the Board of Elections. Fusco told the committee the duplicate four-day filing creates additional work for council staff and the law department, sometimes requiring redaction. He said the legal department advised the city can lawfully remove the local requirement from the code.
Councilwoman Amobian asked whether any law would prevent repeal; Fusco answered that the provision is a local code requirement and that the law department advised the committee the city has authority to eliminate it. After brief discussion, Fusco moved to request time on the item; the committee voted in favor of taking time to consider the measure.
Committee members said they would review the ordinance language and allow time for additional input before returning the item to committee for further consideration.
