Rockford Homes plans to refile an annexation application with the county and the village, council members were told May 19. Staff described the process: once the annexation application is filed, the village has 20 days to pass a service resolution certifying whether the village can provide necessary services; the statute creates a tight timeline and can require special meetings to meet the deadline.

Staff said the company considered a writ of mandamus following the prior denial by county commissioners but decided instead to refile the annexation application. If the developer refiles, the village may need to call special meetings during the statutory 20‑day window to consider and vote on the service resolution; waiving readings and rapid scheduling are legally permissible through posted special meetings, staff said. Councilors were warned that failing to act within the statutory window could result in the matter dying by statute and the developer seeking judicial remedies.

Councilors discussed quorum and scheduling challenges in early June, noting several members will be absent at the June meeting; staff said the village can hold special meetings posted 24 hours in advance to meet deadlines even if only four council members are present. Staff recommended councils vote affirmatively if they believe the village has capacity to provide services; members were reminded that the service resolution is an early procedural step in the annexation process and does not finalize land-use approvals.

No action was taken at the meeting; staff said they would monitor developer timing and call special meetings if the 20‑day window required it.
