Council schedules first readings for Foxfire final plat and Phase 4 development plan

The council scheduled first readings for Ordinance 2025-03, accepting the final plat for Foxfire Subdivision Phase 3 Part 3, and for Resolution 15 (2025), approving the development-plan application for Foxfire Phase 4 parts 1–3.

Staff explained that accepting a final plat records infrastructure (water, sewer and related systems) and generally allows a developer to begin selling lots; developers sometimes provide a performance bond to sell lots prior to plat recording. The village attorney noted council can hold an item for all three readings but in practice councils commonly waive readings to expedite recording; waiving readings requires five council votes, and the village will not have five members present at the June meeting so waiver would not be possible then.

For the Phase 4 development plan, council members asked whether the submission contained all required materials and whether the village engineer had reviewed it; staff said the engineer had already looked at the application and that outstanding questions should be addressed at the developer’s presentation. Councilors said there were no substantive surprises on the material presented and stressed that public infrastructure acceptance is a paperwork step that confirms what is already in the ground.

No final motions or votes were recorded at the meeting beyond placement on first reading. Staff advised the council on the mechanics of plat recording and explained the need for five votes to waive readings under the village rules. Council members asked that the engineer or developer be prepared to answer detailed questions at the subsequent meeting.
