Zoning committee conditionally approves Preserve phases 4 and 5 preliminary plats, requires stormwater plans and covenants

The Sawyer County Zoning Committee conditionally approved preliminary county subdivision plats for The Preserve Phase 4 (seven lots) and Phase 5 (21 lots) after the applicant agreed to DNR stormwater-plan submittals and to carry prior covenants forward.
Jeremy Hill, owner of The Preserve at MBF LLC, told the committee the lots would be five-acre parcels and that roads would remain private and built to town road specifications. Hill said wetland delineations have been completed for Phase 4 and that a local engineering firm is preparing stormwater plans for submittal to the Wisconsin Department of Natural Resources.
Staff recommended conditional acceptance of both preliminary plats with the same requirements used for earlier phases: final approval contingent on formal DNR stormwater-management-plan approval, inclusion of existing covenants from phases 1–3 and completion of any required wetland delineations and erosion-control plans. The Town of Round Lake recommended approval of Phase 4 subject to staff conditions; the Town of Hayward recommended approval of Phase 5 with board signatures and one supervisor abstaining from the town vote.
One adjacent landowner submitted a written comment asking that prospective buyers be notified of nearby gravel pits; the letter noted the area contains several gravel pits and requested deed covenants, disclosures or another form of notice so purchasers are not surprised by periodic operations. Jeremy Hill said he could provide an affidavit or notification to lot buyers to make them aware of nearby gravel operations and told the committee he believed the larger five-acre lots would be the “least dense development and… best for the environment in our area.”
Committee members conditionally approved Phase 4 with requirements that the final plat include approved stormwater plans, the continuation of covenants established in prior phases, and a written buyer notice about nearby gravel pits. Phase 5 was approved similarly: final plat approval will be contingent on DNR stormwater-plan approval, continuation of covenants and wetland delineation where required.
Staff told the committee that final plat recording will be withheld until stormwater plans are approved and that lot development will require separate land-use permits and adherence to the county’s subdivision ordinance (Section 6) and any applicable DNR or erosion-control standards.
The approvals were recorded as conditional preliminary-plat acceptances; committee roll-call votes recorded members as voting yes and the motions carried.
