CityPointe Landfall rezoning and PUD request continued to Nov. 6 after packet errors and conservation easement talks

CityPointe Landfall LLC asked the Brevard County Board of County Commissioners on Oct. 2 to continue its companion small-scale comprehensive plan amendment (H1) and PUD rezoning with removal of an existing binding development plan (H2) to the Nov. 6 planning and zoning meeting so the applicant and staff can resolve discrepancies in the preliminary development plan (PDP) and document a conservation area.

Applicant representative Kimberly Risenka told the board the PDP included with the packet was not the correct version and said the applicant wants the PDP to show a conservation area and to record a conservation instrument to protect about 2.36 acres of wetlands. Risenka also said additional public comments arrived that the applicant had not yet seen and asked for time to address them.

County staff advised the board that continuing the matter is within the board's discretion; staff noted that if the applicant had asked for a change to a different land-use designation it could require new advertisement. Commissioners discussed whether the conservation could be recorded permanently and were told a recorded conservation instrument or easement could be conditioned as part of approval and that administrative or substantial PDP changes would be handled according to the zoning process.

The board voted 3-1 to continue the items to Nov. 6 at 5 p.m. Commissioner Delaney voted no; Vice Chair Goodson, Commissioner Atkinson and Chairman Feltner voted yes. The minutes show the board agreed the continuation would allow staff to include the proper PDP, allow the applicant to include a conservation shown on the PDP and allow the applicant and commissioners to review additional public comment.
