TCEQ adopts enforcement orders (items 630) totaling $852,107 assessed; staff presents monthly enforcement report

The Texas Commission on Environmental Quality adopted administrative enforcement orders covering items 6 through 30 during its Oct. 22 meeting. Executive director staff reported the total assessed administrative penalties across those items at $852,107, with $63,744 deferred, $408,045 applied toward supplemental environmental projects, and $380,318 directed to general revenue.
Megan Hamilton of the enforcement division and colleagues presented the enforcement packet and answered commissioners' questions; the Office of Public Interest Counsel indicated support for adoption of the orders. A public commenter who had signed in on one enforcement item ultimately declined to address the commission after a technical disconnect.
Following adoption of items 630, staff presented the monthly enforcement report for fiscal year 2025 through August. Amy Sedemeyer reported 1,170 effective contained supplemental environmental projects with orders assessed totaling $13,158,723 and payable amounts of $8,378,575. The staff reported 19,049 notices of violation issued, 1,932 enforcement-action referrals, 3,213 pending administrative orders with a temporary backlog of 1,480 cases, and noted plans to address the backlog. The staff said the September backlog shows an overall decrease to be reported next month. The commission took no separate action on the monthly report, which was presented for consideration.
A motion to adopt items 630 as recommended by the executive director passed by voice vote.
