The Texas Commission on Environmental Quality on Oct. 22 granted an authorization to construct for Arkansas Electric Cooperative Corporation to allow installation of an underground oil-water separator and other early wastewater-treatment components at its proposed Naples power plant in Morris County.
Steven King, director of compliance and support for Arkansas Electric Cooperative, testified briefly in support and said he was available to answer questions. The executive director's staff told the commission the applicant had demonstrated that authorization was necessary to allow orderly, efficient construction and that the authorization would not bind the commission's final permitting decision; any construction undertaken would be at the applicant's risk.
The Office of Public Interest Counsel supported the authorization, noting the separator is one of the first necessary pieces of equipment and that building the component can allow construction and project scheduling to proceed. Commissioners emphasized that granting the authorization is not an endorsement of the merits of any pending wastewater permit application and reminded the public that construction prior to a final permit is at the applicant's risk and may require design changes depending on final permit terms.
A commissioner moved to grant the authorization and issue the executive director's proposed order; the motion passed by voice vote.
