Board approves relocation and reuse of a moved house as residential garage in Madaket with conditions

The Planning Board approved May 15 a special permit to relocate an existing structure and repurpose it as a residential garage on 34 Tennessee Avenue (part of a larger parcel associated with 36 Tennessee LLC), with conditions restricting use to the owner and prohibiting rental or commercial use.
Applicant Paul Sandhills (surveyor) described the proposal to move a portion of a dwelling to an abutting lot separated by a paper road (Oklahoma Avenue). The applicant said HDC and Conservation Commission approvals for the move and a related Order of Conditions from the Conservation Commission were in hand. Planning staff summarized that because a paper road bisects what functions as one ownership, the relocated structure requires a special permit to be the primary use on the receiving lot.
During public comment, Bruce Mandel, representing the Madaket Community Application Review Group, asked that the planning board hold the application for additional review and argued that the structure’s placement is between setback buffers; he urged less‑impact siting. Conservation Commission member Jay Turk explained the commission allowed the move because the project reduced existing footprint in the resource area and overall improved the resource area configuration.
Staff confirmed the parcel boundaries and showed that much of the apparent developable area near the proposed site is constrained by wetland buffers and other resource lines; the approved HDC and Conservation Commission materials show the relocation and reuse as proposed. The board’s approval included staff‑recommended findings and the following conditions: the structure shall be used only as an accessory residential garage for the property owner at 36 Tennessee Avenue; it shall not be rented or used for commercial purposes; and the project must comply with any outstanding HDC and Conservation Commission conditions.
The motion to approve the application with conditions passed unanimously. The board instructed staff to include the final HDC approval and the ConCom order of conditions in the planning record.
