The Oak Creek Plan Commission on May 13 approved a preliminary subdivision plat for a nine‑lot single‑family subdivision located at 9025 South Nicholson Road with conditions requiring completion of stormwater and development agreements and coordination with utilities.
Todd, planning staff, said the property is zoned RS-3 and the proposal is for seven single‑family lots plus two outlots; lots are shown at roughly 10,500 to 11,400 square feet and the overall density is 1.68 units per acre. He described Outlot 1 as the perimeter area containing stormwater management and Outlot 2 as the landscaped terminal in the new permanent cul‑de‑sac that will be maintained by the homeowners association. Todd said four trees meeting preservation thresholds would be removed and the applicant proposes planting 12 replacement trees on the site.
Justin Johnson of Pinnacle Engineering Group, appearing for the applicant, stated that while several trees are in poor condition, the project will save "maybe 6 or 7 trees" that are in good shape and will replace trees removed. Resident Randall Burandt, whose home is Lot 57 adjacent to the temporary cul‑de‑sac, expressed concerns about specific trees along his lot line, who will pay for street trees, drainage impacts, and whether construction traffic could use an existing Nicholson Avenue pavement instead of bringing heavy equipment through the new subdivision. Planning staff replied that street trees and spacing will be required in the development agreement and that the developer must manage stormwater on site; staff also said they would look into routing construction traffic and the location of any utility boxes.
Commissioner Donnie moved to approve the preliminary plat submitted by Ervig Heizaj (Almag LLC) with standard conditions: compliance with relevant code requirements, submission of revised plats before permits, execution of development and stormwater agreements, coordination with the Oak Creek Water and Sewer Utility, and incorporation of reviewing-agency comments. Mark seconded; roll call showed one no vote by Luzakowski and otherwise ayes, and the motion carried.
Next steps identified by staff include submittal of a stormwater management plan, execution of development agreements for public infrastructure, and final plan review prior to building permits.
