ALRB reports $12,500 settlement in Betteravia Farms retaliation case

General Counsel Julie Montgomery reported that an unfair labor practice complaint against Betteravia Farms LLC and Spanta Maria Harvesting was resolved by an informal bilateral settlement executed May 8. The complaint, case number 2023CEO14-FAL, alleged retaliation and other workplace violations by a cauliflower harvester in Santa Barbara County.
The complaint was filed after the general counsel’s investigation found cause; Montgomery told the board the settlement required the respondent to pay “full amount back or back wages of $12,500” and to permit ALRB agents to conduct supervisor training and provide the standard noticing and release. Montgomery said the complaint had been filed on December 30, 2024, and the settlement was finalized in early May.
Executive Officer Santiago also noted agency case work earlier in the meeting when updating members on pending matters. Santiago said some matters have been held in abeyance by the education unit pending further action by charging parties or the general counsel, and he summarized the status of other pending filings before the board.
The settlement closes the administrative complaint but Montgomery did not describe any additional enforcement steps beyond the settlement terms she read into the record. No board vote or further formal action on the settlement was recorded during the public portion of the meeting.
