The city asked the magistrate to order compliance and to impose fines for continued noncompliance. Groot stated, in announcing the order: "for the failure to obtain to pay the local business tax, it'll be the maximum statutory fine...for the other violations ... the non compliance will result in a fine of $100 and each succeeding day of noncompliance will be a fine of $200 per day." The magistrate ordered the payment schedule and directed that the respondent correct the BTR, utility and signage violations.
The order finds violations for unpaid local business tax, prohibited signs, failure to obtain permits and violations related to grease interceptor and discharge prevention. The magistrate set a compliance period (the city asked for 30 days before fines begin) and specified that the statutory maximum fine for the business-tax failure would apply; for the other violations, the magistrate ordered $100 for the first day of noncompliance after the cure period and $200 for each succeeding day.
Joseph Holstein, the registered agent and business owner, was not present at the hearing. The city presented delivery confirmations and photographic evidence of flag signs and other violations; the magistrate admitted the city's packet into evidence and entered the order.
The magistrate's order will be issued in writing and enforced by city code staff; the transcript records no appeal or subsequent action taken at that hearing.
