The City Commission approved a mitigation agreement resolving code-enforcement liens on a commercial property at 1515 Southwest 60th Avenue, accepting a payment of $2,500 to be paid within 30 days. If payment is not received within the deadline the lien will revert to the original amount.
Staff said the property’s building suffered a fire in 2011 and the new owners purchased the property with existing unresolved violations. The manager said the violations primarily involved lighting in the parking area; staff confirmed the site now meets the city's lighting requirements and the property has obtained required permits and a 40‑year recertification.
Terry Proctor, attorney for the property owners, said his clients purchased the site on a short sale, remedied the fire damage, obtained permits and were unaware of lingering penalties and liens. He asked the commission for mitigation; the attorney proposed $2,000, staff had recommended $5,000, and the commission settled on $2,500 payable in 30 days. The motion passed 5-0.
Mayor and commissioners characterized the agreed amount as reasonable given the circumstances and noted the city’s interest in resolving compliance where owners have brought properties into conformance.
