The Reuben Conservation Commission voted Sept. 25 to require a Request for Determination of Applicability (RDA) for a petition to remove seven marked trees at 73 Central Street.
Conservation Administrator Teresa briefed commissioners that the removal request comes after a denial in a prior order of conditions for a larger project; she said the Department of Environmental Protection dismissed a prior appeal when the applicant withdrew it and that the commission’s prior denial remains the final order. Given the prior denial and the sensitivity of the area (trees inside the 100-foot riverfront/riparian area were noted), staff recommended an RDA to ensure abutter notification.
A commissioner moved to require an RDA; a voice vote was recorded with the chair calling for ayes and no opposed noted in the minutes. The administrator noted the trees are marked on site and that staff will notify the applicant of the RDA requirement so the filing can proceed.
Commissioners discussed whether other tree-removal requests around town should follow the same path; one commissioner objected to setting a broad precedent but the commission generally agreed that this site’s history and prior orders made the RDA appropriate.
Staff said it would notify the applicant and arrange a site visit as part of the RDA process.
