Council approves BG Mine roadway settlements affecting three properties

The Bonita Springs City Council approved a settlement package for three properties affected by the BG Mine roadway project, resolving land and berm-impact issues and authorizing staff to complete necessary permit-related approvals.
City attorney Derek Rooney described the settlements as somewhat more complex than earlier ones because the proposed roadway design would affect an existing berm and local hydrology on the affected parcels. He told the council the settlement documents include owner approvals to allow the city to pursue permits that either retain portions of the berm or modify it in ways that preserve existing hydrological function. Rooney said settlement funds would be paid from BG Mine escrow accounts and would not come from the city’s general fund.
Matt (staff) said he assisted in negotiations and recommended approval. Council voted to approve the settlement agreements; a roll call showed unanimous Ayes from Council member Bogaz, Deputy Mayor Purdon, Council member Carr, Mayor Gibson, Council member Corey, Council member Fullick and Council member Fitzpatrick.
No additional action was taken at the meeting beyond approving the settlement documents and authorizing staff to proceed with the permitting and design steps the settlements enable.
