ZAB denies conditional use for personal care home at 585 Scarborough Road

The Henry County Zoning Advisory Board on May 8 denied a conditional-use application to operate a non-home-occupation personal care home at 585 Scarborough Road in Ellenwood.
Planner Heidi Lighthood explained that a personal care home provides non-medical care for up to six non-family adults and requires state licensure (referencing OCGA 30-1-712). “A state license is required per OCGA 30 one-seven-twelve,” Lighthood said in her presentation. Staff recommended approval subject to conditions, including upgrades to the septic system if needed and compliance with the Unified Land Development Code.
Applicant Ramejas Adewar told the board the site would care for vulnerable adults and initially planned for four residents with one caregiver on duty. “I'm requesting for this property to be zoned for personal care to enable us take care of the vulnerable amongst us,” Adewar said.
Board members asked whether environmental health’s septic determination accounted for staff and turnover; staff confirmed environmental-health review would require the owner to upgrade the system if necessary. Fire and building clearance would be required during plan review and business-license processes.
A motion to deny the conditional use carried 3-1 with board member Richard recorded in opposition. The board recorded the case as CU2411 and placed conditions in the staff report for any future approval process, including required state licensing and building/fire inspections prior to operation.
