In a bond-reduction hearing in the 187th District Court, defense counsel asked the court to reduce the $30,000 bond for defendant Leroy Smith, who appeared by videoconference and whose counsel said Smith requires dialysis.
Defense counsel said Smith was late to an earlier appearance but apologetic and that Smith lacks prior criminal history and cannot make the $30,000 bond. Counsel asked the court to lower the bond to an amount between $5,000 and $10,000 that Smith and his wife could afford. The prosecutor indicated the state had reviewed the motion.
Judge Stephanie Boyd queried whether the bondsman had been contacted and suggested defense counsel speak with the bondsman to determine whether previously paid premiums or contract terms could be reinstated; she offered to rehear the motion if the bondsman would not accept the prior contract. The court permitted the defense to call and confer with the bondsman and told counsel the court could recall the matter the next day and have the defendant appear by Zoom.
No immediate bond reduction was entered; the court’s next action depended on the bondsman’s response and possible recall for rehearing.
