Judge orders Moses Martinez held for transfer to treatment after violating deferred adjudication

In the 187th District Court, Judge Stephanie Boyd heard a revocation hearing for Moses Albert Martinez, who pleaded true to a violation of condition number 41 related to deferred adjudication for possession with intent to deliver.
The court reviewed counts alleging possession with intent to deliver a controlled substance (penalty group 1, 4–200 grams). Martinez acknowledged he understood that a plea of true to the violations exposed him to punishment ranging from five years to 99 years or life in prison and up to a $10,000 fine. The court confirmed Martinez’s plea was knowing and voluntary.
Defense counsel asked for continued or modified conditions. Judge Boyd told Martinez he had two choices: immediate revocation with a five-year prison sentence, or continued custody pending transfer to a treatment program (referred to in court as “safety” and with aftercare). The court denied a motion to alter conditions to allow Martinez immediate release; instead it ordered Martinez remain in custody until transferred to the safety program and to complete aftercare. If Martinez completes those programs, the court said it would consider another referral to felony drug court.
Judge Boyd told Martinez the potential sentence for the violations if he were revoked could include life in prison and urged him to seek treatment, saying she would help find a treatment placement if he requested it upon release. The court scheduled follow-up handling as appropriate if drug-court referral becomes feasible after program completion.
Background: Martinez was on deferred adjudication in a 2020 cause for possession with intent to deliver. The court found violation of conditions in counts 1 and 3 and set the defendant’s confinement pending transfer to treatment and aftercare.
