154 Goodale Street hearings continued; owner absent, commission asks petitioner to withdraw RDA and proceed under enforcement order

The Peabody Conservation Commission continued two items related to 154 Goodale Street — a Request for Determination of Applicability and a related enforcement matter — after the property owner did not appear at the May 7 meeting. Commissioners said they expected the owner to withdraw the RDA and handle remediation under the commission’s enforcement order.

The matter is a post-facto filing regarding fill brought into the rear of the property; enforcement is being pursued under a friendly enforcement order. At a site visit earlier in the process, commissioners and staff reported discussing withdrawal of the RDA and resolving the work through an amended enforcement order.

Commission staff said the owner had indicated willingness to withdraw but had not yet submitted written notice of withdrawal or completed the amended enforcement paperwork. Commissioners agreed it was preferable to have the owner appear and accept the amended enforcement order in person to ensure he understands obligations and timelines.

Commissioner Amanda Green moved to continue both agenda items to the June meeting; Commissioner Arthur Athas seconded and the motion passed 6–0. Staff will contact the owner and request either a written withdrawal of the RDA or presence at the June meeting to finalize an amended enforcement order.
