Applicant counsel Alex Wilson described the project as an assisted‑living style health care facility for up to 14 residents. The proposed use exceeds the by‑right limit of eight residents in the R‑2 zone and thus requires special exception approval under Subtitle U §203.1(j); the project also seeks relief from the minimum vehicle parking requirement in Subtitle C §701.5 because an existing driveway lies in public space and DDOT has requested closure of the curb cut.
Wilson said the project will have three staff on site per shift, scheduled visitor hours and daytime deliveries between 7 a.m. and 9 a.m., and submitted a detailed operations manual (Exhibit 17F) describing protocols. Office of Planning representative Maxine Brown‑Roberts told the board OP recommends approval, and DDOT told the board it has no objection to the requested parking relief if the curb cut is closed because the site is near transit and the closure will add on‑street spaces.
ANC 4B Commissioner Doug Payton said the ANC had requested continuance because the ANC and neighbors felt the applicant had not adequately presented to the full commission; Commissioner Payton and multiple neighbors described concerns about parking spillover onto adjacent streets, trash pickup in a 15‑foot alley, and the scale of locating 14 residents in a house the neighbors described as about 1,515 square feet. Several neighbors spoke in opposition at the hearing citing parking, trash, and neighborhood impacts; one nearby resident, Dr. Emmanuel Hialeah, testified in support, describing a need for local assisted‑living options. The board directed the parties to meet with the ANC on May 27 (the ANC’s meeting date) and asked the ANC to file a report by May 30; the applicants will provide responses by June 6 and the board set a continued hearing for June 11.
