Commissioner presenting the plat said fees were paid and paperwork was in order. The backup materials include a letter from a water provider (identified in the backup as an agreement with "Beth Bethel Ash") confirming an intent to supply water, but that provider declined to sign the specific 30-year commitment form required under Appendix E because of grant-related implications. The county planner explained the 30-year signatory is often requested to support future grant applications; when a provider will not sign a 30-year guarantee, the court may grant a variance so development can proceed while preserving the county's ability to require infrastructure standards.
Joy Kimbrough and the developer, identified as Miss Phillips, were present and confirmed that all fees had been paid. Commissioner McCam moved to approve the final plat and the variance; Commissioner Richardson seconded. The court approved both motions unanimously.
The action approves the subdivision layout and allows the developer to proceed with final plat recording subject to standard county filing procedures. The variance relieves the developer from providing the 30-year written commitment in the exact Appendix E format; it does not relieve the developer of other infrastructure obligations or future permitting requirements.
