The Board approved a petition to waive full road-paving requirements on Kelly Road in order to allow an eight-lot subdivision to proceed, subject to a fair-share payment and a right-of-way dedication. Staff said the waiver conforms to county standards for limited, small-generation subdivisions on substandard roads and recommended acceptance of an appropriate fair-share contribution.
Planner Tahir Curry described the request: the applicant proposes to subdivide a 76.47-acre parcel into eight lots; four lots will front Kelly Road and four will front South Heta Canal Road. Kelly Road is currently an unimproved county road with a 63-foot right-of-way and narrow pavement. The waiver request included a required 35-foot right-of-way dedication to the county along Kelly Road.
Engineers calculated the developer's appropriate fair-share contribution to roadway improvements as $328,653. County policy requires the payment be held and used for paving improvements; if the county does not use the funds within 10 years they must be refunded to the applicant. Staff recommended approval with conditions, including plat language that future owners must participate in any future municipal service taxing units, MSBUs or benefit districts that finance paving and drainage improvements.
The Board voted to approve the paving waiver and accept the fair-share contribution subject to the conditions in the draft resolution.
