Commission seeks monthly litigation briefings and spending thresholds after surprise legal bills

Commissioner Morgan raised the item, saying the commission had been surprised by substantial litigation expense billed to the city and recommending a monthly summary of pending or potential legal actions be provided to the commission. “I think we need a little bit more transparency on what potential or pending litigation the city is facing,” Morgan said, adding that the commission should be briefed on the status of cases before budgeting decisions.
City staff and counsel said they could provide a short monthly report listing open cases, filing dates and public-record status updates without disclosing privileged strategy. The city manager and the law firm noted that if commissioners wanted substantive discussion about particular matters, a closed (executive) session could be scheduled. Commissioners also discussed adopting a policy that sets a spending threshold for litigation where the full commission would be notified or asked to authorize spending above a set amount; staff said the city manager currently has authority to approve expenditures up to $15,000 and that commissioners requested earlier notification when that threshold may be approached or exceeded.
Mayor and other commissioners supported monthly reporting and more explicit preauthorization steps for high-cost litigation to avoid unexpected budget impacts.
