Resolution seeking exception under ‘201’ agreement dies for lack of motion at committee

A resolution seeking an exception to a “201” agreement for property south of High Plains Road and west of South Greeley Highway did not receive a motion and therefore did not advance from the Public Services Committee on May 5.
Planning Director Charles Blum said staff and the applicant have not completed coordination with county environmental health and that the applicant’s agent (Tanya Keller) was seeking a committee recommendation to forward to the governing body. Blum explained that the “201” exception process is triggered by a denial of a permit tied to a specific proposed use; without an active proposed use, staff said the denial may not exist and the exception process may be premature.
When the committee called for public comment and a motion, no motion or second was made. The committee chair declared the item died for lack of motion and said there will be no recommendation for the Monday City Council meeting. Staff told the committee they plan further meetings with the applicant and environmental health to clarify the application and to return when ready.
The committee’s lack of action leaves the item to be reconsidered later, after further coordination between the applicant, city staff and county environmental-health officials.
