Committee accepts 8-foot utility easement from McGregor Pace parcel on Midway Boulevard

The Utility Safety and Environment Committee on May 7, 2024 approved accepting an eight-foot utility easement on a parcel owned by McGregor Pace that fronts on Midway Boulevard.
Engineer Schneider told the committee the easement was requested during the McGregor Pace review at the planning commission because the existing right-of-way on Midway Boulevard is only 50 feet wide and the additional eight feet would provide space for future utility work. “We thought it would be prudent for future, in case we ever need to do any utility work out there, to have the proper have some proper spacing,” Schneider said.
The committee record lists the parcel by parcel number (06-24-032-107-032). Schneider said he did not have the parcel’s street address at hand and that the easement fronts on Midway Boulevard even though the parcel may carry a Leona Street address in the parcel file.
The acceptance ordinance was moved by Councilmember Armstrong and seconded by Councilmember Stewart; the motion carried by voice vote. Committee members confirmed no emergency clause was required for the easement acceptance.
Staff noted that the easement was granted voluntarily by the property owner during the planning commission review and that the city requested it to preserve corridor capacity for utilities.
