The Memphis City Council approved a special-use permit for vehicle sales at 5205 Winchester Road after hearing from Division of Planning and Development staff, the applicant’s attorney and the applicant.
DPD staff presented the case and recommended rejection, saying the proposed use is not consistent with surrounding approvals and could be injurious to the neighborhood. Hassan Ostadnia of DPD described the site as surrounded by residential and commercial properties and said staff recommended rejection because the use would be “injurious for the neighborhood.”
David Bray, representing the applicant, told the council the applicant had revised the site plan after acquiring adjacent property and moved display spaces to avoid disrupting circulation through the shopping center. Bray said the plan addresses staff concerns about landscaping and circulation and that the applicant agreed to the recommended conditions.
The applicant, who identified himself as Jose Olivazquez and said he owns the building at 5205 Winchester Road, spoke through a translator and said the project aims to sell lower-cost used cars to lower-income buyers and that the business owner already operates an insurance agency at the same address. "We are all agreeing in order to make any modification on or everything to be needed in order to get the approval," Olivazquez said.
Council members asked questions about the existing site and the applicant’s plans. One council member noted neighborhood outreach and the applicant’s willingness to address issues raised by nearby residents. Council members then moved the item and cast votes; the council recorded the item as passed.
Action: council approved the special-use permit (case SUP20Five-three) for vehicle sales at 5205 Winchester Road. The approval was taken after the applicant revised the site plan to address staff concerns and after neighborhood engagement. DPD had recommended rejection; the council voted in favor of approval with conditions listed in the staff report.
Next steps: DPD will file the final conditions and the applicant must comply with landscaping, circulation and other conditions identified in the staff report before operating vehicle sales at the site.
