Summary
Senator Perry presented HJR 2 to prohibit the state from enacting estate, inheritance or similar transfer taxes. The committee opened public testimony and heard none, then later voted to report HB/R 2 favorably to the full Senate.
Senator Perry presented HJR 2 to the Senate Committee on Finance, saying the proposed constitutional amendment would bar the state from enacting “a death tax, estate, inheritance, legacy, succession, gift, or generation‑skipping transfer tax” on individual estates or trusts.
“Consistent with the themes we did earlier this year regarding capital gains, the state legislature passed SB 752 to repeal Texas’ version of the death tax,” Senator Perry said, noting his view that estate taxes “are one of the most punitive” and that eliminating the possibility of such a tax would protect family businesses.
The committee opened public testimony on HJR 2; no one registered to testify and testimony was closed. With a quorum present, the committee later took a recorded vote and the clerk announced “12 ayes, no nays,” after which the chair said the measure would be reported favorably to the full Senate.
The committee did not receive extended public comment and did not debate the measure at length during the hearing. The transcript shows the committee proceeded to other business after reporting the item.
No court rulings, statutory citations beyond SB 752, or additional legislative language were discussed on the record during the hearing.
