Summary
Council approved first readings of three ordinances to abandon and sell three small parcels (0.087, 0.13 and 0.366 acres) near Williams Street and Abney; appraised values and buyer costs were presented. Mayor recused from these items and Mayor Pro Tem Schenkel presided.
The council approved first readings of three separate ordinances to abandon and sell small unused alley and right-of-way parcels near Williams Street and Abney.
City staff said the three undeveloped areas lie in the old Lufkin town plot and that there are no city utilities in the alleys or the right-of-way. Staff said it followed Chapter 272 of the Texas Local Government Code for notification. The council was asked to consider approval of each sale separately.
Item 7 was described as a 0.087-acre portion of alley on the west side of Williams between Oak and Persimmon. Staff reported an appraisal value of $4,800 and a total buyer cost of $5,300, which includes an appraisal fee and filing fee. Item 8 was a 0.13-acre portion of an alley between Abney and Oak Avenue with an appraised value of $7,500 and a total buyer cost of $8,000. Item 9 covered a 0.366-acre portion of unapproved right of way associated with Oak Avenue with an appraisal of $12,000 and a total price of $12,500 including fees.
Before those items were heard, a council member recused for conflict, saying, "For items number 7, 8, and 9, I'm going to recuse myself, being that I'm the applicant, and turn these items over to Mayor Pro Tem Schenkel." Mayor Pro Tem Schenkel then presided over the items. Councilors moved and seconded approval on each item and recorded aye votes.
If approved, staff said purchasers would be issued deeds without warranty upon payment and that the properties would be replatted together as required.
