Shelby council declares old Main Street fire station surplus, tables code update and advances alley vacation; executive session set on property matters

Council members took several property and procurement actions during the meeting, including placing on file a letter declaring the old Main Street fire station surplus, tabling an ordinance to update the codified ordinances, approving steps to vacate part of an alley and authorizing disposal of surplus equipment.

Under new business a council member said the old Main Street fire station "has outlived its usefulness and is no longer needed for municipal purpose" and moved to have the mayoral letter received and placed on file so the city can identify retained access and utilities that must remain. The motion to receive and place the letter on file was discussed and recorded; no sale or transfer was finalized during the meeting.

Council debated Ordinance No. 9-2025, a package to edit and include ordinances into the codified ordinances. Several members asked why the council was treating the update as an emergency and requested department reviews of the updated language to avoid transcription or wording errors. Council voted to table Ordinance No. 9-2025 until the next meeting so department reviewers can confirm language accuracy; the motion to table was moved by Mr. Martin and seconded by Mr. Roberts and the motion passed by roll call.

The council also considered a correction to a prior alley vacation in Ordinance No. 10-2025, described as changing incorrect lot numbers; staff told the council the substantive action remained the same and the change was clerical. Separately, Resolution No. 13-2025 declared the council’s intent to vacate a section of an alley running perpendicular to West Main Street; presenters explained that in typical alley vacations the halves of the alley revert to adjacent property owners, and that access easements would be recorded to preserve needed access. Council voted by roll call in favor of the alley-vacation intent resolution.

On equipment and surplus property, council approved a resolution to sell a 1987 Winco diesel generator with trailer used by the Shelby Fire Department as unneeded property and authorized the mayor and public-safety director to sell it on internet auction platforms. Council also reviewed a Sourcewell cooperative purchasing request for a Bobcat compact excavator with accessories for the service department; the matter was presented with an emergency purchase rationale.

Before adjourning, council voted to move into an executive session to consider the purchase or sale of property (both real and personal) under the revised code citation provided at the meeting. The motion to enter executive session was moved by Mr. Martin, seconded by Mr. Roberts, passed by roll call, and the mayor, law director and the identified staff member were asked to join the closed session.

Why it matters: Declaring city property surplus, vacating alleys and authorizing surplus-equipment sales are early steps in reusing or disposing of municipal assets; tabling a comprehensive codification package pending department review is intended to prevent errors that could change regulatory meaning.
