Mayor explains Ohio annexation timeline after latest Strutman proposal rejected by county

Mayor (role: Mayor) told residents the village follows the Ohio Revised Code when developers request annexation and laid out the step-by-step process that applies to Commercial Point.

"When we start doing annexations ... in the state of Ohio, there's 5 types of annexations," the mayor said, describing regular, municipal and three expedited categories. He said most developer requests follow an "expedited type 2" process because "all the property owners wish to be annexed." He added: "We have to get our service resolution ... to the county commissioners in 20 days. That's the only way it can happen, and that's why they pass them as an emergency measure."

The mayor recounted the village's recent experience with the roughly 344-acre Strutman property, which he said has been proposed to the village multiple times since 2021. He said Commercial Point staff met with the developer, the council passed a service resolution and the county commissioners previously approved the resolution and scheduled it to return to the village. In the most recent filing, the mayor said, the county commissioners declined to allow the annexation to proceed and the proposal stopped at the county level.

Village Solicitor Bill (role: Village Solicitor) echoed the mayor's explanation about statutory timelines and said municipalities routinely use the emergency and readings waiver steps to meet Ohio Revised Code deadlines; otherwise, the village would be out of compliance. He told the meeting: "If we didn't have an emergency, we would call it a special meeting ... This is one of the most transparent organizations there is."

Village Administrator John (role: Village Administrator) provided infrastructure capacity figures the mayor and other speakers used to explain why the village's service resolution described available services: he reported the water treatment plant's average daily flow for April was about 450,000 gallons per day with a 1,000,000 gpd capacity and the current wastewater plant averaged roughly 474,000 gpd with a permitted capacity of about 440,000 gpd; the village is commissioning a new wastewater plant with capacity the mayor said will exceed 2,000,000 gpd and that the start-up "takes 30 to 45 days."

Council members and staff repeatedly framed the emergency designation and waiver of readings as a procedural requirement under state law, not a local attempt to bypass public notice. Several councilors urged residents to review posted meeting packets and to call village offices with questions; the mayor and solicitor also emphasized that residents can request more information from the village staff.

Discussion vs. decision: Council did not take a new vote on annexation during this meeting. The mayor described past votes and county action on the Strutman proposal, and village staff described required timelines and the village's ability to provide services. The county commissioners' rejection of the most recent Strutman filing, as described by the mayor, halted that specific annexation at the county level.

Why it matters: Annexation determines which local government provides services, which public safety and utility capacity apply, and whether township roads or school districts will see added demand. Several residents at the meeting cited concerns about traffic and school capacity for large developments, and councilors and staff explained what elements (traffic studies, developer-funded road improvements, water/sewer upgrades) would be resolved in later approvals.

The council moved on to other agenda items after the mayor's report; no new resolution on annexation was introduced or voted on at this meeting.
