The Fairhope City Planning Commission voted unanimously Tuesday to grant a one-year extension for SD 23.04, the Clump planned-unit development (PUD) preliminary plat, the commission chair said after a staff presentation and discussion.
Planning staff explained the preliminary plat was approved nearly two years ago and is set to expire next month. "So the preliminary plat that we have and approved, almost 2 years ago expires next month," a planning staff member told commissioners, and staff recommended granting the extension to avoid restarting lengthy technical reviews.
Commissioners discussed but did not take formal action on a separate and new zoning request for the same parcel that, if approved by the city council, would replace the existing PUD and require a new preliminary plat. Planning staff said the new zoning application is a separate case and affirmed that, if the commission grants the extension, the city would require re-advertising and public notice if the project returns with different plans. A staff member said the commission should not "sneak it back on the agenda" without re-advertising.
Commissioners asked about the commission's usual practice for extensions. Staff said first extensions have generally been granted fairly freely in recent years — sometimes 90 days, one year or longer — particularly when projects are substantially under construction; but staff noted this situation differs because an approved PUD site plan currently governs the site while a new zoning request is pending.
A motion to grant a one-year extension for SD 23.04, for preliminary plat approval, carried unanimously. The commission recorded no additional conditions on the extension beyond staff's recommendation that the matter be re-advertised when any new or revised plans are ready to return to the commission.
The discussion included a staff note that one outstanding item tied to the original approval was a wetlands clarification; staff referenced prior conversations with the applicant's consultant on that point. The commission did not vote on any zoning change at the meeting.
