Commission signals support for administrative variances, lower vote threshold and appeal route to commission

City staff presented requested options May 6 for revising Board of Adjustment procedures: (1) an administrative-variance track for minor, de minimis dimensional relief; (2) whether the BOA should continue to require a supermajority (majority plus one) for variances; and (3) where appeals of BOA decisions should go.
Staff recommended limiting administrative variances to existing single-family and accessory structures, applying existing variance criteria and restricting administrative relief to the smaller of 10% or 1 foot for setbacks and height. Members reviewed other Florida cities’ approaches showing administrative relief commonly in the 10–25% range.
Commission discussion favored expanding administrative relief and a tiered approach. Commissioners directed staff to draft an ordinance that would allow administrative variances for very small dimensional requests up to 25% or up to 3 feet (whichever is less), subject to zoning administrator review, with a right to appeal denials to the Board of Adjustment. On vote thresholds, commissioners preferred using a simple majority for BOA approvals rather than the existing supermajority. For appeals, the commission supported routing appeals from the BOA to the City Commission (a quasi-judicial review) rather than having them go directly to circuit court; the commission asked staff to examine use of the special magistrate as an intermediate forum and to address whether changes should apply retroactively to any pending cases. Staff will return with draft amendments and a recommended process for implementation.
