The City of Oviedo Local Planning Agency on May 6 approved a deviation allowing an accessory dwelling unit (ADU) at 6615 Lake Charm to be built to 1,504 square feet, a 504-square-foot increase over the 1,000-square-foot maximum in the adopted 2024 land development code.
Property owner Beverly Evans told the panel she and her husband want the ADU so they can continue living at their Lake Charm home as they age; she said the family has lived on Lake Charm since 1972 and constructed the primary house in 1981.
City staff told the LPA the applicant originally submitted a building permit for the ADU in 2024 before the city adopted the new LDC standards. Staff found no unusual physical constraints on the rectangular lot and concluded the ADU’s scale and intensity would be compatible with adjacent properties given the proposed setbacks. Staff recommended approval with a condition: the applicant must plant shrubs or bushes and two palm trees from the Florida Friendly list around the ADU.
Staff’s findings noted the applicant stated the deviation is the minimum necessary to "accommodate medical equipment" that will be used within the ADU. The LPA took a motion to approve the 504-square-foot deviation (a 50.4% increase over the code maximum); the motion carried without recorded opposition.
The decision allows the applicant to pursue building permits for the larger ADU, subject to the required plantings and standard permit review and inspections.
