On Monday, May 5, 2025, the Elyria City Council voted to adopt four ordinances amending the city's codified ordinances to add a definition for "medical marijuana entity" and to allow medical marijuana facilities as conditionally permitted uses in several zoning districts.
The measures, introduced by Community Development and taken up that evening, amended Elyria Codified Ordinances Chapter 11.25 (definitions) and multiple sections of Chapter 11 (including 11.35, 11.60.b, 11.64.l–i and 11.66.h–i) to explicitly include cultivation facilities, processing facilities, dispensing areas and testing laboratories as conditionally permitted uses. Each item was the subject of a public hearing at the meeting; the clerk recorded no proponents or opponents during those hearings.
Councilor Mr. Schneider asked that each ordinance be passed at second reading under suspension of rules and declared an emergency; Miss Mitchell seconded the motions. For each ordinance, the council called the question and recorded vocal "ayes" with no recorded "nays," and the mayor or presiding officer declared the motions carried. The ordinances adopted that evening were recorded in the minutes as Ordinance 2025-61, 2025-62, 2025-63 and 2025-64.
The changes add medical marijuana entities and facility types to the list of conditionally permitted uses in the named zoning districts rather than making them outright permitted uses; that means proposed facilities must still secure the city’s conditional-use review process before locating in those zones. The council's emergency declarations indicate the body intended the ordinances to take immediate effect as provided by city rules and state law.
