Council rejects bids for enterprise substation transformer citing nonconforming bids

Napoleon City Council voted to reject all bids received for the Enterprise substation transformer, after city staff reported nonconforming proposals and missing documentation among the bidders.
Greg Coleman, the city’s electric superintendent, told council the bids contained defects that made them unacceptable and said staff recommended rejecting all proposals under the city’s procurement ordinance so staff could negotiate directly with a bidder if appropriate.
Council and staff gave examples of nonconforming issues: missing documents, a bidder not licensed to do business in Ohio and a vendor submission that lacked an access panel the city considered necessary for future inspection. City counsel and staff said rejecting the bids would allow the city to pursue negotiations with a bidder under an exception to the bidding rules if it is in the city’s best interest.
Council approved the motion to reject the bids on a roll call vote. Staff said they would pursue negotiations with potential vendors or reissue the procurement documents as appropriate and return to council with next steps.
