The Stephens County Planning Commission on May 6 approved a variance allowing a 16-by-40 accessory structure to remain within the front yard at 1343 Jordan Road in Toccoa.
Planning staff told the commission that the structure was sited after an electrical permit was pulled and discovered to be located in the front yard in violation of county ordinance. Staff cited chapter 59, article 16, section 59-16-10, which permits accessory buildings only in side or rear yards, and recommended a variance because the property is nearly four acres, the structure sits about eight feet in front of the principal structure, and there is significant vegetative buffering between the structure and the neighboring property.
Staff recommended approval if the accessory building caused no adverse effect on right-of-way, utility infrastructure or the neighborhood. No members of the public spoke in opposition at the hearing. Following the public hearing, commissioners moved, seconded and approved the variance; the meeting record notes the motion carried but does not show roll-call vote detail.
The planning commission's approval permits the existing structure to remain; further enforcement or condition changes would follow county code procedures.
