Committee narrows contractor‑provider requirements to administrative regulation; staff to refine language on background flags

The policy committee on May 6 reviewed proposed administrative regulation language for contracted service providers that would require pre‑service clearances for contractors who have direct contact with students.
The AR would require criminal‑history checks, tuberculosis testing where applicable, mandatory‑reporting training and confirmation that contractors understand their mandated‑reporter obligations. Staff said much of the detailed language that used to be in the policy was moved into the AR to keep the policy concise and to provide operational procedures in the regulation.
Members requested clearer definitions or examples of what constitutes an applicable contract and asked staff to revise specific phrasing regarding background‑check flags. One board member suggested that wording implying the district merely ‘‘objects’’ to an assignment when a flag appears could let contractors evade responsibility. Staff said they would change the language to state that a contractor who fails to meet clearance requirements may not assign that employee to the district and would examine the clearance questionnaire for unintended consequences (for example, a prior investigation that resulted in no finding of abuse should not automatically bar an assignment).
Staff indicated they will redraft the AR wording to reduce ambiguity and return the revised AR to the committee for review. No formal board action occurred at this meeting.
