Jay Buchholz explained why the county created a temporary guest‑quarters permit after encountering both storage areas and fully furnished habitable spaces above garages that had never been permitted. He said the temporary guest‑quarters option allows less than 500 square feet of sleeping space, requires an affidavit that the space will not be rented, and triggers UDC (Uniform Dwelling Code) inspection requirements. "Those temporary guest quarters are also required per our ordinances... require a UDC inspection... ingress and egress... carbon monoxide detectors," Buchholz said.
Committee members and the public raised safety and enforcement concerns: detached, unpermitted habitable spaces may lack proper fire separation, escape routes and building inspections; enforcement is made harder because county staff cannot enter private structures without permission. Buchholz also noted an outstanding case in which an owner claimed the 10‑year statute limiting zoning enforcement might allow continued habitable use above a garage; that case may establish case law the county will need to follow.
The committee did not adopt regulatory changes at this meeting but discussed options including continuing to require permits and inspections for any permitted habitable conversion, relying on UDC inspection for rentals, and pursuing enforcement when a use is illegal. Staff noted temporary guest‑quarters signage (a yellow bar beneath the property fire number) is being used to identify permitted guest quarters.
