Finance committee approves temporary easement with Danielson and second amendment to Rush River MOU

John Shockley, representing the Diversion Authority, presented two agreements the committee approved on April 23: a temporary construction easement and access agreement with James Danielson, and a second amendment to the Diversion Authority’s memorandum of understanding with the Rush River Water Resource District.
The temporary construction easement allows the authority’s contractor to access Danielson’s property to remove ballast and sub-ballast from the right-of-way; the easement is temporary and the property will return to the underlying owner after removal, Shockley said.
The Rush River amendment further defines roles and responsibilities for drain transitions, specifically naming Drain 2 (Lower Rush River), Drain 12 (Rush River), and Drain 30; the amendment states the district is responsible for designing and constructing drain transitions while the authority will reimburse the district for that work and may consider requests for remnant-drain maintenance funds if there is a deficiency.
Both agreements were moved, seconded and approved by roll call. The committee recorded the motions as actionable items under agenda items 7(a) and 7(b).
