DeLand special magistrate amends compliance date, orders fines and entries of compliance for multiple properties

Special Magistrate Julie Zolte presiding over the City of DeLand code enforcement special magistrate hearing on April 24, 2025, amended a prior order for 606 N. Clara Ave., set a new compliance deadline and entered a series of orders finding some properties in compliance and imposing fines on others.
The magistrate amended the compliance date for property at 606 N. Clara Ave., owned by Jonathan K. Lee and Denise A. Lee, to April 30, 2025, and ordered that fines of $100 per day may begin to accrue on May 1, 2025, if the required permit is not issued. City staff told the magistrate the permit application was in review and expected to be issued once outstanding fees are paid. The magistrate scheduled a compliance hearing for May 22, 2025, to determine whether the property is in compliance.
At the hearing the city reported that Vasil and Nadia Boycek (1315 E. International Speedway Blvd., case CE24-1644) submitted an affidavit showing the property came into compliance before the deadline; the magistrate entered an order of compliance with no fine due.
The magistrate found Scott Portal Homes LLC (324 N. Fairview Ave., case CE25-17) remains in violation for roof and drainage defects and ordered fines of $150 per day to begin accruing as of April 22, 2025, until the violation is corrected, based on staff reinspection and the absence of a permit or communications from the owner.
Robert E. Feasel and Anna K. Feasel (326 W. Minnesota Ave., case CE25-0169) submitted evidence showing the property came into compliance on April 7, 2025; the magistrate entered an order of compliance with no fine due.
Lucille C. Mattingly (225 N. Sans Souci Ave., case CE2041588) was ordered to pay a fine of $8,750 after the magistrate found the property failed to comply by the February 24 deadline; the record shows the fine ran for 35 days and the property came into compliance on April 1, 2025.
August Terminkus and Mary Jane Terminkus (1367 Hensley Drive, case CE2041594) were assessed a fine of $19,250 after fines of $250 per day ran for 77 days; staff reported the property came into compliance on April 8, 2025, and the magistrate entered an order of compliance with that fine due.
Legacy Investments of Central Florida LLC (435 W. Waltz Ave., case CE20-515) was found in compliance with no fine due.
Oregon LLC (250 W. Highland Ave., case CE20-568) was the subject of an amended order to correct a scrivener's error (the required correction clarified electrical repairs). The magistrate also entered an order finding Oregon LLC had been in repeat violation; fines at $500 per day ran for 30 days for a total of $15,000, and the magistrate entered an order that the fine is due following the property's reported compliance on March 28, 2025.
The magistrate noted several matters were removed from the agenda by the city (cases CE23-0426, CE24-0321, CE24-0506 and others listed on the record). The next special magistrate hearing was set for May 22, 2025.
"I will enter an order," Zolte said when announcing the amended compliance date for the Clara Avenue property and the schedule for the May 22 hearing.
The proceedings were conducted as quasi-judicial hearings; testimony was taken under oath and recorded, and the magistrate cited Florida Statute Section 286.0105 regarding the record needed to pursue an appeal.
