Planning commission approves multiple final plats and waivers, advances several residential projects

The Berkeley County Planning Commission voted to approve several final plats and a subdivision waiver and to advance multiple preliminary plans, clearing the way for new single-family lots and townhome sections in several developments across the county.

Commissioners accepted staff recommendations for final plat approval or final-plat determination for Nestle Junction Section 2 (four single-family lots on 11.27 acres), Southbrook Section 2 Phase 5 (41 single-family and 16 townhouse lots on 44.84 acres), Communities of Burwell phases 10, 11 and 12 (multiple single-family and townhouse lots), Foxtail Mills Phase 4 (28 townhome lots on 2.67 acres), and instructed advertisement of public hearings on selected final plats for the June 2, 2025 planning commission meeting. Staff recommended and the commission required surety amounts for several projects as a condition of plat release.

For Nestle Junction, staff recommended a surety of $201,364.80; the commission approved a motion to require that bond and to release the plat upon receipt of the surety and a developer's agreement. For Southbrook, staff recommended a surety of $1,058,676; the commission approved a motion to require that bond and release upon receipt of surety and developer's agreement. Communities of Burwell Phase 11 was approved contingent on a surety of $382,129.50; Phase 12 was approved contingent on a surety of $26,400. Foxtail Mills Phase 4 and Communities of Burwell Phase 10 were accepted for final-plat determination and scheduled for public hearing on June 2, 2025.

The commission also approved a waiver for Steely Lane after staff said the Berkeley County Health Department evaluated existing septic systems and established reserve areas. Planning staff read a health-department letter from Michaela LaCour, Sanitarian 2, stating that the Berkeley County Health Department approves the subdivision because the lots already have septic systems and established reserve areas. "Since proposed lots 1 and 2 are already improved and the health department is in favor of the subdivision, staff recommends approval of the waivers," staff said. Commissioner Norton moved to approve the waiver; Commissioner Barrett seconded the motion and it passed by voice vote.

The planning commission advanced Southside Towns — a preliminary plan proposing 12 townhouse lots on 1.3 acres — to the final-plat stage after the county engineer deemed the preliminary plan compliant with the subdivision ordinance. Todd Heck of Morris & Ritchie represented the applicant on that item.

Motions on the various items were made and seconded by planning commission members and carried by voice votes; the transcript records approvals but does not include roll-call tallies. Several project representatives appeared during hearings, including representatives identified as Mister Llewellyn (Nestle Junction), Rick Perry (Integrity Federal Services, Southbrook), Mike Roberts (Burwell Properties), Todd Heck (Morris & Ritchie, Southside Towns), and a representative for Thomas Companies at Foxtail Mills. The staff record cites county-engineer reviews dated April 24–28, 2025 for compliance determinations on multiple projects.

Planning staff closed the meeting by reminding commissioners of a final public engagement workshop on the comprehensive-plan update scheduled for Thursday from 6 to 8 p.m.; the staff also noted stakeholder focus-group workshops earlier that day.
