City legal staff notified the Public Safety and Community Health Committee on May 5 that a resolution on the consent agenda would allocate funds to settle a civil claim related to alleged misconduct by a former city police officer.
Linden Smithson, assisting the finance/legal team on property and liability settlements, told the committee the matter is unusual and that the proposed resolution authorizes an initial payment to remedy property damages with a later capped total for the claim. Smithson also noted a separate, high‑profile personnel matter: "We did settle Miss Presnell's case ... for $300,000. This resolution is to settle the second case with ... the second victim for $400,000," Smithson told the committee.
Smithson said parts of the matter will be discussed in executive session later the same day and that the settlement language includes a cap and an initial payment threshold intended to make the affected taxpayer whole while allowing the administration to complete the remaining negotiations without returning to council for additional routine payments.
