Council amends and advances fee-code revision to second reading

Huntington City Council on first reading considered and amended a multi-section ordinance that revises municipal code language governing collection of service fees, lien costs and interest rates.
Assistant City Attorney Erica Hernandez told council the revision covers five separate ordinances (municipal service fee, refuse service fee, vacant building and stormwater provisions) and codifies state law practice the city has been following. Changes described by Hernandez include recognizing a five-year statute of limitations for service-fee collections, aligning lien-interest rates with judgment interest rates, clarifying that filing fees will be collected at payoff, and noting that penalties stop accruing once a lien is filed.
Councilmember Holly Mount moved a technical amendment to replace the phrase "Huntington sanitary board" with "Huntington stormwater utility" beginning in section 9-35.08 and continuing through the ordinance; Councilmember Walling seconded. The amendment carried and the ordinance was amended and advanced to second reading.
Hernandez said the changes primarily align the city code with state law and make existing practices explicit in the codified ordinances. The council voted to move the ordinance to second reading after the amendment.
