The Rules Committee of the Utah State Board of Education voted to approve two waiver requests allowing charter schools to proceed with enrollment and satellite plans despite missing the October 1 reporting deadline.
The waivers concerned Canyon Grove Academy’s request for a small expansion of up to 100 seats for the 2025–26 school year and Valley Academy Charter’s request to correct a reporting date for an approved satellite campus. Committee members approved both waivers and agreed to forward them to the full board for final approval.
Canyon Grove’s request was presented as arising from changes to the Utah Fits All scholarship program enacted during the 2025 legislative session; staff said Canyon Grove also has the support of the State Charter School Board. The committee approved Canyon Grove’s waiver unanimously among those present.
Valley Academy’s request resulted from a clerical error: paperwork filed with the state charter school board initially reflected a 2026–27 approval date rather than 2024–25, meaning the school missed the October 1 reporting deadline. The committee approved Valley Academy’s waiver and forwarded it to the board; the motion recorded four votes in favor and one abstention from board member Lear.
The committee did not take additional substantive conditions or amendments on either waiver; staff and legal counsel were available to answer committee questions prior to the motions.
