During review of the Community Preservation Committee (CPC) language, committee members noted a statutory change to the Community Preservation Act (CPA) that expanded eligible uses to include rehabilitation of playground equipment and recreational facilities.
Members recommended that the CPC bylaw be edited to reflect the current statute rather than attempt to restate the full statutory language in the bylaw. Committee members proposed either (a) replacing outdated enumerations with a short cross-reference to “uses enumerated in the relevant CPA statute,” or (b) updating the bylaw text to include the statute’s expanded language. The committee favored the shorthand cross-reference to reduce the risk the bylaw text would fall out of date as statute changes.
The committee also discussed the CPC’s internal practice and suggested keeping an explicit-by-practice consultation with the Finance Committee and the Select Board when preparing budget recommendations, even if that consultation is not mandated by statute. Members said that retaining the consultation language was “good practice” and helps align the CPC’s recommendations with municipal budget planning.
