Commissioners approve vacation of county right-of-way near Gretna Landing in 4-1 vote

The Sarpy County Board of Commissioners approved a resolution on April 29 to vacate portions of county right-of-way along South 190 Eighth Street adjacent to the Gretna Landing development (H and S Bank 192 LLC). The resolution follows a county engineer recommendation and a published public hearing held pursuant to statute.
Deputy County Attorney Andrea (Andy) Gosnell Parker explained the process to commissioners, saying the application had been filed, electors verified and the county engineer provided recommendations on which portions should be vacated. "The resolution before you reflects the recommendation of the County engineer on which portions to vacate as well as directs that such vacation should it pass, the land will revert to the adjacent landowners," Gosnell Parker said.
Commissioner Warren Mixon moved to approve the resolution; Commissioner Kelly Burmeister seconded. The board approved the vacation by a 4-1 roll-call vote (ayes 4, nays 1); the board did not record additional conditions in the meeting record. The deputy county attorney confirmed that the public hearing was set and published pursuant to statute prior to the board’s action.
The resolution directs that, upon vacation, the vacated right-of-way will revert to adjacent landowners as provided in the county’s disposition procedures. The county engineer’s recommendation and the public-hearing record will be included in the official resolution documents.
