House Education panel advances bill shortening TSPC complaint timeline, adds civil penalty authority

The Oregon House Education Committee voted to advance Senate Bill 805, which shortens the period in which the Teacher Standards and Practices Commission may close a complaint that was not resolved locally. Chair Neron opened a work session on SB 805 and asked committee staff for a summary before debate and votes.

Committee staff said SB 805 reduces the time within which TSPC can close a complaint when no attempts were made to resolve it locally from 12 months to six months and applies to complaints filed with TSPC on or after Jan. 1, 2026. The bill's dash-2 amendment removes a requirement that TSPC render a decision at its next meeting after a hearing, allows TSPC to impose a civil penalty of up to $1,000 for violations, credits penalty proceeds to TSPC's account in the state treasury, and permits TSPC to adopt rules to implement the penalty. The amendment sets an operative date of July 1, 2026, and allows TSPC to adopt implementing rules in advance.

Vice Chair Dobson moved adoption of the dash-2 amendment. With no objections recorded, Chair Neron announced the amendment was adopted. Vice Chair Dobson then moved SB 805, as amended, to the floor with a "do pass" recommendation; the committee recorded no objections and the bill was reported to the House floor. Vice Chair McIntyre volunteered to be the bill carrier on the House floor.

The committee record shows Representatives Winn and Ruiz were excused during the work session. No roll-call tally was taken on the amendment or the final recommendation because the committee disposed of both by unanimous voice or no-objection procedure.

If enacted as written, SB 805 would shorten the window for TSPC to close certain complaints and add a limited civil fine mechanism tied to TSPC rulemaking. The bill's application date for complaints is Jan. 1, 2026; the bill's operative date is July 1, 2026.
