ALRB reports multiple court deadlines in appeals and federal lawsuits

The Agricultural Labor Relations Board said Thursday it is facing multiple court deadlines in both state appellate and federal litigation, Chief Board Counsel Laura Heick told the board.
Heick said the board and the United Farm Workers filed reply briefs in an appeal to the Fifth District Court of Appeal on April 22 and that the case “is now fully briefed and awaiting the schedule of scheduling of oral argument.” She also reported several federal filings, including a motion to dismiss in Wonderful Nurseries LLC v. ALRB in U.S. District Court for the Eastern District of California and a plaintiffs’ motion for a preliminary injunction in Hill and Western Growers Association v. ALRB in the U.S. District Court for the Southern District of California.
The board’s filings and deadlines, as recited by Heick, include: the ALRB/UFW reply briefs filed April 22 in the Fifth District Court of Appeal; the board’s April 7 motion to dismiss in Wonderful Nurseries LLC in the Eastern District of California and Wonderful’s April 29 response (with the board’s reply due May 8); the board’s answer filed April 28 in Chavez et al. v. ALRB in Kern County Superior Court; and a plaintiffs’ preliminary-injunction motion filed April 24 in Hill and Western Growers Association v. ALRB, with the board’s response due May 15 and a response to the complaint due June 9.
Heick offered the schedule as the litigation report and asked if the board wanted additional detail; no members raised questions during her remarks.
The board did not take formal action on any of the matters during the open meeting.
